Dr Nandipha Magudumana’s bail application was heard on Friday, July 14, 2023, at the Free State High Court in Bloemfontein but the issue of consent was a contentious issue during the hearing bare. Kessler Perumalsamy, who defended Dr. Nandipha Magudumana in court, said there were grounds for her case to continue to the Supreme Court of Appeal. Her defense argued that one can never consent to illegal conduct. He added, “I agree with the unconstitutional conduct.” Furthermore, her lawyer asserted that if Dr. Nandipha Magudumana agrees to extradite her to South Africa, it must be official. Kessler asked during her application hearing, “Was she informed about the treaty between South Africa and Tanzania? What did she agree to? Disguised extradition? Was it after the Home Office exercised its powers illegally? When and to whom is consent given? Is it in writing?”
In April, Dr. Nandipha Magudumana was detained and arrested in Tanzania along with her boyfriend Thabo Bester, who had escaped from prison.
